Celebrate Eid ul Fitr - According to the Islamic basis of Qur’an and Sunnah

According to science (http://moonsighting.com/1432shw.html), “The Astronomical New Moon is on 29 August 2011 (Monday) at 3:04 UT. On 29 August it can not be seen anywhere in the world, except Southern part of South America and Polynesian Islands. On Tuesday, 30 August 2011, it can be easily seen everywhere except Northern Asia and Northern Europe (See visibility curves)”. It means there is no remote possibility to see moon of Shawwal in Saudi Arabia on 29 August 2011 OR at any other place in the Middle East, Asia, North America, Africa, etc… Lets read what Islam says about fasting and Eid as Prophet Muhammad (peace be upon him) commanded, "Do not fast unless you sight the crescent, and do not break your fast till you sight the (following) crescent.” (Al-Bukhari, Vol. 3:130). Beloved Prophet Muhammad (peace be upon him) said, "See the moon and commence fasting and see the moon and end fasting and if the skies are overcast, then complete the counting of thirty (days)." (Sahih Bukhari) Ibn Umar (May Allah be pleased with him) reported, I heard the Prophet (peace be upon him) saying, "When you see the crescent (of the month of Ramadan), start fasting, and when you see the crescent (of the month of Shawwal), stop fasting; and if the sky is overcast (and you can't see It) then regard the crescent (month) of Ramadan (as of 30 days, in other words complete 30 days)". (Sahih Bukhari) Abdullah bin Umar (May Allah be pleased with him) reported that the Prophet (peace be upon him) said, "The month (can be) 29 nights (i.e. days), and do not fast till you see the moon, and if the sky is overcast, then complete Sha'ban as thirty days." (Sahih Bukhari) Abu Hurairah (May Allah be pleased with him) reported that the Prophet (peace be upon him) said, "Start fasting on seeing the crescent (of Ramadan), and give up fasting on seeing the crescent (of Shawwal), and if the sky is overcast (and you cannot see it), complete thirty days of Sha'ban." (Sahih Bukhari) Huzayfah (May Allah be pleased with him) reported that the Prophet (peace be upon him) said, “Do not fast (for Ramadan) before the coming of the month until you sight the moon or complete the number (of thirty days); then fast until you sight the moon or complete the number (of thirty days). (Abu Dawood) Let’s see what ISNA (FCNA) has already decided, “The Fiqh Council of North America (FCNA) recognizes astronomical calculation as an acceptable Shar'i method for determining the beginning of Lunar months including the months of Ramadan and Shawwal. FCNA uses Makkah al-Mukarram as a conventional point and takes the position that the conjunction must take place before sunset in Makkah and moon must set after sunset in Makkah. On the basis of this method, the dates of Ramadan and Eidul Fitr for the year 1432 AH are established as follows: The first of Ramadan started on Monday, 1 August 2011 and Insha-Allah Eid ul-Fitr will be on Tuesday, 30 August 2011. Science says it will be impossible to see moon on August 29, 2011 in Makkah and the rest of the world except the southern most tip of South America. Saudi government also claims that they declare Ramadan and Eid based upon the moon-sighting of local Saudi witnesses. On what basis ISNA (FCNA) has announced Eid ul Fitr on Tuesday, August 30, 2011? Is this not a clear violation of Prophet Muhammad’s (peace be upon him) guidance? Since when Southern most tip of South America became our reference point? These guys are openly undermining the Islamic Shari’a and playing with it as it pleases them. These guys are doing with Islam what Muslims blame Christians and Jews did with their religions. Shuwwahl 1432 A.H. Those dedicated people, who take the trouble to study the signs of Lord Almighty(swt) in the sky indicate that the Shuwwahl Helaal is not expected to be seen anywhere in Asia, Africa, Europe or N. America on the evening of Monday Aug. 29, 2011.The only exception being the far South Western parts of South America. On Tuesday Aug. 30, 2011 it is to be seen, in many countries in Asia, Africa, Europe and the Americas. Consequently Eidulfitr will be on Wednesday Aug. 31, 2011 in all the countries of Asia, Africa, Europe and N. America, by the design and will of Lord Almighty(swt). www.moonsighting.com and www.icoproject.org are utterly wonderful facilities for the Muslims the world over. These have been providing absolutely trustworthy Shahahdah i.e. eye witness account of crescent observation from across the world, every month since the last 16 years. The Shahahdah shown on the above websites are indeed, the commands of Lord Almighty(swt). Every faithful Muslim obeys no one but Him. Taferqah among Muslim Ummah, comes when some people calling themselves Muslims give more importance to the words of their Malah or to the stories than to the words of Lord Almighty (swt). Other websites of interest are: www.hilalsighting.org and http://Qasweb.org/newcrescents.htm (Fil lesahn ul Arabia) Sighting possibility for Helaal for Shuwwahl 1432 A.H. in Makkah. The following is the forecast of Helaal sighting possibility in Makkah as given by H.M. Nautical Almanac Office, an associate of the Royal Observatory at Greenwich. S.E. London. Reproduced here with their kind permission. Times are in Standard Time = GMT + 03h 00 Time of Moon at Sunset Time of Sunset Age of moon Alt El Moonset Lag time Moon status. Lag time, is time it will take moon to set after sunset. Age of moon (minimum required is around 18 hours). The Muslim Ummah are urged to get into the habit of relying on the most authentic Shahahdah obtained through the websites mentioned below, thus show obedience to Allah's edict "Walah taferruqoo". Those living in the northern areas of the world should embrace the Shahahdah of observation from the southern areas and those living in the southern areas of the world from the north, as it happens, that the Helaal may be seen in the north for a few months and then in the south in other months of the year. The Shahahdah from across the world will be available to see on: www.moonsighting.com/1432shw.html and www.icoproject.org/icop/shw32.html in due course of time. The lesson learned from fasting: Continuing the new routine, after Rumadahn by keeping mid day food intake to a bare minimum will be a very good idea taking lesson from the advantages of fasting learned during Rumadahn. The lesson learned is that by cutting off mid day intake the digestive system gets some rest hence its efficiency is improved by the time it is time to eat again in the evening. Feasting on the last day of Ramadan: This ritual and “Festival” is organised in Arabia every now and then, if not always. One case history among the many is that on Saturday Nov. 13, 2004 when the Muslims of the entire world were observing constraints of Ramadan, the Saudees, the Sudanese and possibly the Somalis were feasting on this day. Why? Because of the innovation i.e. Bidah of the government officials in Riyadh. Bidah is to use a home grown formula for producing Helaal from under the hat by just announcing the advent of the new month without anyone seeing the Helaal in Arabia or in any country around Arabia. The reason for this exercise, in all probability is to achieve what Lord Almighty has not designed i.e. to organise Eid on one day all over the world without the will and design of the Lord. The effect and result of this exercise achieves the opposite i.e taferqah among the Ummah. Last Eiduladha was on Wednesday all over the world, as per the will and designs of Lord Almighty, but those in Riyadh, Ankara and some other countries defied the Lord and created taferqah by committing the transgression of artificially calling the 8th day of Dhulhijjah to be the 9th. Monday was the 8th day East, West, North and South of Arabia, yet it was called 9th day only in Arabia. The Moroccans a few thousand miles West of Arabia and all those who obey the Lord by what He shows in the sky celebrated Eiduladha on Wednesday. Do Arab Ulamah have any part in this sacrilege? No. In fact it is a curse for the Arab Ulamah in general and for those in Musjidul Haraam in particular. One can imagine as to what kind of torture it must be for the honourable Arab Ulamah and for those in Musjidul Haraam, when the Ulamah knowing very well that it is the last day of Rumadahn as per their search for Helaal, are ordered to feast on that day. Why do the Ulamah not do anything about it? Due to Autocracy, the Ulamah have no power to refuse the order they receive from Riyadh. No matter how much sacrilegious it may be. Is it not a sacrilege of monumental scale to enforce a falsehood upon the holy Musjidul Haraam ? Should every Muslim everywhere in the world not oppose it? How can one know this fact to be true? By comparing the Shahahdah gathered from across the world available on the abovementioned websites with what they hear from Riyadh. We can also look above to the “Sighting possibility for Helaal for Shuwwahl 1432 A.H. in Makkah” and see that on Aug 29, 2011 there is no chance of Helaal being seen anywhere in and around Arabia or anywhere in Africa. But those with experience are speculating that the moonset just 4 minutes after sunset on this day, gives good enough excuse to the officials in Riyadh to declare the next day to be the first of Shuwwahl. So we must wait and see as to what the officials in Riyadh do. If they do as speculated, they will be ordering the celebration of the “Festival” of feasting on the last day of Rumadahn, celebrated many a times previously in Arabia. All those living in Asia, Africa, Europe and N. America who obey Lord Almighty for what He shows in the sky will be celebrating Eidulfitr on Wednesday Aug. 31, 2011 in their submission to the will of Lord Almighty. Allah is pleased with those who propagate the Truth. So propagating this Truth everywhere is to seek the pleasure of Allah. . JazahkAllah khairun wa shukrun. Pop Star Plays in Masjid

An international pop star was allowed to play his music in a musjid. Though he was only given approximately a minute, the pop star got immediately on the act and used his minute to the full. His complete band played along while he sang some lines from his latest release. There was a mixed response from those present. While most of the congregation were enraged, some did not seem too bothered. After all, they also had pop bands playing …on their CELLPHONES. This is unfortunately the tragic situation in most musjids. Pop bands have played in the houses of Allah. In fact, as unthinkable as it may have been previously, music is often played around the Ka'ba Shareef and right in front of the Rowdah Mubaruk (mausoleum) of Rasulullah r , albeit from a cellphone. Indeed, we lament the hardships and calamities that constantly befall us. Yet, we directly draw down the wrath of Allah Ta'ala upon ourselves. In a lengthy Hadith Rasulullah (Sallallahu Alaihi Wasallam) warned: "If my Ummah becomes involved in fifteen aspects, calamities and hardships will befall them." Among the fifteen aspects mentioned is when music and musical instruments will become rife in the Ummah. Therefore when even the Musjids – and the Haramain Sharifain – have not been spared from blaring music, what doubt can there be that this is a significant contributing factor in drawing down calamities? It is therefore imperative that for the sake of Allah Ta'ala we switch off all musical tones. NA'THS Al-hamdulillah many people have avoided musical ringing tones but have downloaded Qur'anic recitations, na'ths and nazams as ringing tones. While listening to the recitation of the Qur'an or to listen to the praises of Allah Ta'ala and His beloved Rasul (Sallallahu Alaihi Wasallam) are very meritorious, using these recitations as ringtones is highly inappropriate for many reasons: - The phone would invariably ring in places where it is not permissible to recite the Qur'an or any na'th, such as in the toilet. Even if one generally takes care to switch off the phone, one is at times likely to forget to do so. Thus one would be responsible of taking the name of Allah Ta'ala in the toilet — an act of gross disrespectf. - When the phone rings one would answer it as soon as one's hand reaches it. The recitation of the Qur'an or the name of Allah that is being recited will stop immediately. Sometimes, as a result of the sudden stop, the name of Allah Ta'ala or the name of Rasulullah (Sallallahu Alaihi Wasallam) which is being recited at that moment will be cut in half. This is also disrespectful. - The most important reason is of the misuse of the Qur'an or the name of Allah Ta'ala and Rasulullah (Sallallahu alaihi Wasallam) and reducing it to merely a sound to attract one's attention to a telephone call! The purpose of listening to the Qur'an being recited is to acquire the reward of ibadah and to increase one's Imaan. Likewise the purpose of listening to the recitation of na'ths is to imbibe the love of Allah Ta'ala and His beloved Rasul (Sallallahu Alaihi Wasallam) into one's heart. These forms of ibadah should not be reduced to merely a ringing tone. Therefore one should simply adopt a plain non-musical ringing tone. May Allah Ta'ala save us from actions that draw His wrath and from all forms of disrespect. Aameen. Source- alhaadi.org.za Madrasah Taleemud Deen- Isipingo-South Africa

WHAT IS FIQH ?

WHAT IS FIQH? Generally a misconception exists that Fiqh is a science which is in contradiction to the science of Hadeeth. It is sometimes even alleged that if an individual follows Fiqh, he is opposing the Ahaadeeth of Rasulullah (Sallallahu Alayhi Wasallam). This then results in some even saying that Fiqh is mutable and can be changed. However, this is incorrect since Fiqh is not an innovation of latter times. Instead it is actually the explanation and application of the Ahaadeeth. It is common knowledge to anyone who is familiar with the science of Hadeeth, that one will find apparently contradictory Ahaadeeth regarding a single situation. Some of the reasons for this apparent contradiction are that at times Rasulullah (Sallallahu Alayhi Wasallam) issued a ruling but it was restricted to a specific situation, or this ruling was later abrogated by another verdict. Now if an individual wants to follow the Hadeeth directly, which of the Ahaadeeth will he follow? Therefore the only option that he has is to follow the Fiqh of a qualified Imaam which will show him the application of these apparently contradictory Ahaadeeth. Let us take a simple practical example to illustrate this point. A person enters the Musjid and finds the Imaam in ruku`. Now, one Hadeeth commands him to join the Imaam in ruku` (Musannaf `Abdur Razzaaq, #3373). However if he joins the Imaam he will be contradicting another Hadeeth which says: “The Salaah of the one who does not recite Surah Faatihah is not accepted” (Bukhaari, #756). Both these Ahaadeeth seem to be contradicting each other. At this point this individual will be forced to refer to a Faqeeh who will explain to him the correct application of these Ahaadeeth. The Faqeeh will tell him that he should join the Imaam in ruku` and his Salaah is valid. He will further explain that the Hadeeth regarding the recitation of Surah Faatihah does not apply to him, rather it applies to an Imaam and a munfarid (a person offering Salaah by himself). As for a muqtadi (the one following an Imaam), the Hadeeth: “Whoever is following an Imaam, the recitation of his Imaam suffices on behalf of his recitation,” (Musannaf Ibnu Abi Shaibah, #3800) applies to him. The above manner of reconciling between the Ahaadeeth and applying everything to its proper place is what is meant by the statement “Fiqh is the correct application of the Hadeeth”. It is for the very same reason that the great Muhaddith Abdullah bin Mubaarak (Rahmatullahi Alayh) used to say: “Do not say: ‘This is the view of Abu Hanifah’. Rather say: ‘It is the explanation of the Hadeeth’.” (Manaaqibul Imaamil A`zam - `Ali Al-Qaari, Al- Jawaahirul Mudee’ah vol. 2, pg. 460) DIFFERENCE BETWEEN A MUHADDITH AND A FAQEEH: The difference between a Muhaddith and a Faqeeh could be easily understood from the difference between a pharmacist and a doctor. The pharmacist may be an expert in the different types of medication, their properties, the different pharmaceutical companies that manufacture them, the alternatives, etc. However, he can only dispense medication and is not in the capacity to prescribe the appropriate medication for the specific illness. This is the work and duty of a doctor and physician. Similarly, in the era of the Tabi'een and in the period that followed thereafter, there existed mainly two groups of Ulama. One group had dedicated themselves to the preservation, collating and memorisation of the text of the Ahaadeeth together with their different chains of transmission. They also studied and scrutinized each chain of narration and the life of each narrator. They were known as the Muhadditheen. On the other hand, there were those who had devoted their lives to understand the correct meaning and intent of the Qur’aan and Hadeeth and deduce laws and injunctions from them. They were called the Fuqahaa. Imaam A`mash (Rahmatullahi Alayh), the great expert of Qiraat and Hadeeth, explained this difference in his famous statement: يا معشر الفقهاء ! أنتم الأطباء ونحن الصيادلة “Oh Fuqahaa (jurists)! You are the physicians and we (the narrators of the Ahaadeeth) are the dispensers.”(Manaaqibul Imaamil A`zam - `Ali Al-Qaari, with Al- Jawaahirul Mudee’ah, vol. 2, pg. 484) The difference between a Muhaddith and a Faqeeh has also been pointed out in the following Hadeeth: قال رسول الله صلى الله عليه وسلم : نضر الله امرأ سمع منا حديثا فحفظه حتى يبلغه ، فرب حامل فقه إلى من هو أفقه منه ، ورب حامل فقه ليس بفقيه (رواه أبو داود ، رقم : 3660) Rasulullah (Sallallahu Alayhi Wasallam) said: “May Allah Ta`ala keep that person radiant who hears from us a statement and remembers it until he conveys it, since there are many people who convey Fiqh (by narrating the Hadeeth) to those who have greater understanding than themselves (the narrators), and many a person carries Fiqh but is not himself a Faqeeh (Jurist).” The last two statements of this Hadeeth refer to a Muhaddith who merely carries the Ahaadeeth from which Fiqh is derived, and conveys it to the Faqeeh who deduces rulings from it. THE FUQAHAA ARE THE ONES WHO SHOULD BE FOLLOWED: From the above it is absolutely clear that the Fuqahaa were the ones who truly understood the essence of the Qur’aan and Hadeeth. They reached their conclusions after weighing the different arguments, understanding the contexts of the texts and following the correct procedures of giving preference to one narration over another. Therefore Imaam Tirmidhi (Rahmatullahi Alayh), the author of the famous compilation of Hadeeth, writes: الفقهاء أعلم بمعاني الحديث “The Fuqahaa are more knowledgeable about the meanings of the Ahaadeeth.” Thus, we reach this conclusion that since the Fuqahaa have understood the correct meaning and intent of the Ahaadeeth, we are required to follow their explanation. DISASTROUS OUTCOME OF NOT FOLLOWING THE FUQAHAA: Failing to follow the Fuqahaa will result in serious problems. Hereunder are a few examples of the serious problems that can follow if one abandons the Fuqahaa. Moulana Sarfaraaz Khan (Rahmatullahi Alayh) writes: “I have a sincere Deeni conscious friend whose daughter-in-law claimed to follow the Hadeeth. She insisted that the Hadeeth of Saheeh Bukhaari only instructs one to throw three hands full of water over the head for a fardh (obligatory) ghusl and that there is no need to pour water over the entire body. This became such a serious problem that it led to divorce. The Hadeeth which she referred to does appear in Saheeh Bukhaari (#254) where Rasulullah (Sallallahu Alayhi Wasallam) said whilst indicating with both his hands: ‘I pour water over my head thrice.’ However, this is one portion of the Hadeeth. The detailed narration (#256) which appears in the very same chapter after a few lines explains the procedure, where it says that thereafter he (Sallallahu Alayhi Wasallam) poured water over his entire body.” (Al Kalaamul Mufeed, pg. 219) A Hadeeth of Saheeh Bukhaari (#1863) states: “An Umrah in Ramadhaan equals to a Hajj with me (i.e. Rasulullah Sallahu Alayhi Wasallam)”. Similarly another Hadeeth states: “The one who performs Fajr Salaah in congregation and thereafter sits till sunrise remembering Allah Ta`ala and performs two rakaats of nafl Salaah, he would attain the reward of a complete Hajj and Umrah (Sunan Tirmidhi #586)”. If a person looks at the apparent meaning of these two Ahaadeeth without the medium of the Fuqahaa, he would conclude that there is no need for him to perform his Fardh Hajj, since he has already attained the reward of a complete Hajj and a Hajj with Rasulullah (Sallahu Alayhi Wasallam). If he refers to a Faqeeh, he would explain that these Ahaadeeth only refer to the reward of Hajj. However these actions do not absolve him from the obligation which still remains on him. Another real example of the above is: Once a man (who was going for Umrah) came to an `Aalim and said: “The Hadeeth says that one Salaah in Makkah Mukarramah equals one hundred thousand Salaah elsewhere (Sunan Ibni Majah #1406). So if I perform one qadhaa Salaah there, won’t it compensate for all my qadhaa Salaah?” The Aalim replied: “If your deduction is correct, then not only will it compensate for your past Salaahs, rather there will be no need for you to perform any more Salaah in the future as well”. Thereafter he explained to him that this only refers to the reward and not the obligation. From these examples we understand that going directly to the Ahaadeeth without the medium of the Fuqahaa is detrimental to our Deen. In the first situation, the woman’s ghusl was incorrect. Hence none of her Salaahs would be accepted. In the second example, the person would have discarded the fifth pillar of Islaam. In the third situation the person would end up discarding Salaah completely. Therefore, subjecting ourselves to the Fuqahaa is a means of protecting and safeguarding our Deen, as the great Muhaddith Sufyaan bin `Uyaynah (Rahmatullahi Alayh) used to say: التسليم للفقهاء سلامة في الدين “Submitting to the Fuqahaa is safety in Deen.” (Al- Jawaahirul Mudee’ah, vol. 1, pg. 166) He also said: الحديث مضلة إلا للفقهاء “A person can be misled due to misunderstanding the Hadeeth, except the Fuqahaa (i.e. The Fuqahaa are saved from going astray due to having the correct understanding).” (Atharul Hadeethish Shareef, pg. 63) CONCLUSION: In conclusion, when such great experts and luminaries in the field of Hadeeth felt it imperative to follow an Imaam in Fiqh, then how can a layman who depends on a translation of Bukhaari or any other book of Hadeeth regard himself to be absolved of the responsibility of following an Imaam and a Mazhab?
